From Westervelt appeal: At approximately noon on October 6, 2004, a neighbor discovered Timothy Gray, who was unconscious, badly beaten and in a pool of blood, in the backyard of Gray’s residence in the Town of Bethlehem, Albany County. Subsequent investigation indicated that Gray had been attacked the evening of October 5, 2004 when Gray’s housemates, including his girlfriend, Jessica Domery, had been working out of the area. Defendant was identified by police as a person of interest since he had recently dated Domery and, when she terminated that relationship, defendant had engaged in a series of actions aimed at intimidating and harassing Domery and Gray, including an earlier physical altercation with Gray. On October 7, 2004, defendant accompanied a member of the Town of Bethlehem police department to the police station, where he was informed of his Miranda rights, told he was not under arrest, then questioned for about four hours by detectives Charles Rudolph and Christopher Bowdish. He denied involvement in the crime, permitted police to search his car and agreed to return the following day to take a polygraph examination at a City of Albany police station.

On October 8, 2004, defendant was administered his Miranda rights and then began a polygraph examination, which he terminated part way into the process. According to Bowdish and Rudolph, shortly thereafter he told them, “I did it.” While still at the Albany police station, Miranda rights were reread to defendant and he then gave a detailed written statement in which, among other things, he admitted punching Gray, kicking him in the face, striking him in the head and face with a wooden replica hatchet, and leaving a note written in Italian (which he had made using a translation Web site on a computer in a public library) in an effort to detract suspicion. Such a note had been
discovered at the premises. Defendant also drew a map of the crime scene. Defendant was placed in custody and taken back to the Bethlehem police station for booking, where he was again given Miranda warnings. When he expressed remorse about the incident, Bowdish suggested that he write a letter of apology and provided him with paper and a pen. Defendant then wrote a letter to Domery which mentioned his remorse while going on at some length about his feelings for Domery. Subsequently, on October 12, 2004, a correction officer at the county jail overheard defendant making an inculpatory statement to another inmate and the officer then engaged him in a conversation resulting in
further incriminating statements.

From Dennison’s appeal: Mrs. Dennison is a trained nurse of more than twenty-five years experience and has been a member of the nursing staff of the Wetumpka General Hospital for several years and was so employed at the time of the taking of the life of the little child and up until her arrest. After her arrest she confessed to the crime and the confession, as well as other evidence, tends to show she administered the poison by placing it in an orange drink which the little girl drank from a measuring cup, and after the child became very ill and vomited, appellant apparently gave her a drink of Coca-Cola, also containing arsenic poison, which caused the child to vomit again. Shirley Dianne was taken to the hospital about 4:55 P.M. and died some few hours later. An autopsy performed by the State Toxicologist, Dr. C. J. Rehling, indicated she had died of arsenic poison. An examination by this well-known expert of the Coca-Cola bottle, as well as the measuring cup, disclosed a small sediment of arsenic poison and the little girl’s dress, as well as her *554 mother’s which had also become contaminated from the child’s regurgitation, showed a large quantity of arsenic poison. About 5:30 on the same afternoon, while Shirley Dianne was in the hospital, appellant left the hospital and went to Deatsville and paid a premium on a $500 life insurance policy she had taken on the life of the child, which was about to lapse for nonpayment of premium and in which she was the sole beneficiary. There was evidence that appellant had applied for a policy in the amount of $5,000 on the child’s life, which had also been issued and on which she had paid the premium, she being the principal beneficiary therein. If, therefore, it were necessary to search for a motive we would find it here.

From Haber’s appeal: James Joseph Brandt was the admitted killer of Albert Haber. Brandt pled guilty to first degree murder, and pursuant to a plea bargain he received a life sentence. Brandt testified that Betty Lou Haber engaged him and her son by a previous marriage, Arnold Jefferson McEver, to kill her husband in the Haber home on the night of January 24, 1975. The plan was to make it appear as though the murder had occurred during the commission of a burglary. Brandt said that before Mrs. Haber went out for the evening, she left open a sliding glass door to facilitate the entry into the Haber residence that night. Brandt explained that he and McEver went to the residence as planned and put some fake pry marks on the door to make it look like a forceful entry had occurred. The house was placed in disarray in order to make it appear that it had been burglarized. Then Brandt and McEver lay in wait for Mr. Haber to enter the house.

When Haber came home, Brandt struck him with a rifle butt. Then Brandt and McEver beat him several times in the head. The men took some guns and other items from the house with them when they left. Brandt later decided that Mr. Haber might not be dead so he returned alone and shot him in the mouth with a revolver. An autopsy later revealed that the beating rather than the gunshot wound caused Mr. Haber’s death. While Brandt was the only witness who directly implicated the appellants in the killing, there was other substantial evidence which corroborated the fact that McEver participated in the murder and that Mrs. Haber was active in the planning of how it was to be accomplished.
